Conveyancing Process

For property sales our role is to:

  • Obtain your title documents. If you have a mortgage we will request your title deeds from your lender otherwise you will be aware of the whereabouts.
  • Forward copies of the title documents and draft contract to the proposed purchaser's solicitor.
  • Reply to any enquiries that may be raised by the proposed purchaser's solicitor.
  • Forward contracts to you for your signature.
  • Deal with exchange of contracts and thereafter request mortgage redemption figures and prepare accounts.
  • Deal with completion of your sale and forward any balance of funds due to you.

For property purchases our role is to:

  • Ensure that there are no unforeseen legal problems with the property you wish to purchase.
  • Consider the legal implications of your property survey report.
  • When we receive draft documentation from the proposed seller's solicitor we will raise additional enquiries where necessary. Once a mortgage offer is received, a Local Authority Search and any other necessary searches will be carried out.
  • When all documentation is received and we are satisfied all enquiries have been dealt with satisfactorily we will prepare a report and forward all relevant documentation to you. The report will point out all salient facts in relation to your purchase.
  • We will request that you call into the office to go through the documentation at which time you will sign your contract and any other documentation and provide authority for us to exchange and complete. A deposit will be requested which is often 10% of the purchase price unless a reduction can be negotiated prior to exchange.
  • On exchange of contracts a completion date is fixed.
  • Once exchange of contracts has taken place we must request your mortgage advance. Accounts are prepared and forwarded to you requesting any balance due to enable your purchase to take place.
  • Completion is effected and thereafter we deal with any Stamp Duty Land Tax issues and registration at the Land Registry of the transfer of the property.
  • Once the title deeds are received from the Land Registry duly registered into your name the deeds will be forwarded to you.
