Aletta Shaw has recently secured a Not Guilty Verdict of a driver by proving that he was holding his ‘sat nav’ rather than his mobile phone.
Our client was charged with having no insurance whilst driving. Unbeknown to him his insurance was cancelled two weeks before he was charged and as such technically he was driving without insurance. As our client was a new driver, he could have attracted 6 points which would have led him to retaking his driving exam to obtain a further license. With our representation our client received no penalty points and kept his license.
Recent Motoring Result We helped remorseful young man who was charged with drink driving to keep his disqualification to 9 months after completing the drink drivers rehabilitation course.
Aletta Shaw has recently protected the driving licence of a man who admitted driving an HGV carrying a wide load over Dartford Bridge. He had no HGV Driving Licence, he was not insured and he was using a mobile phone when stopped. We were able to set out the complicated series of facts explaining why he drove in exceptional and unusual circumstances and we were able to satisfy the court that the ‘special reasons’ defence should apply. The result was that even though he pleaded guilty he did not receive any points on his licence and he did not have to pay any legal fees because we persuaded the Court to pay them as well.
Temporary workers who work for a continuous period of at least 12 weeks will have the same rights in relation to pay, holiday pay and overtime as full-time staff under a new European rule which comes into force on 1st October 2011.
